Welcome to Doku. These Terms of Service ("Terms") govern your access to and use of the Doku mobile application, website, and related services (collectively, the "Service"), operated by Kuma Stories Ltd ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of legal majority in your jurisdiction), you must have the consent of your parent or legal guardian to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate or if you violate these Terms.

3. User Conduct and Content Moderation

Doku allows users to interact with content and post comments/ideas in supported areas. You agree not to:

Moderation: We maintain a zero-tolerance policy for objectionable content and abusive users. We provide tools within the app to report inappropriate content and block abusive users. We reserve the right, at our sole discretion, to remove any content and suspend or terminate accounts that violate these guidelines.

4. Intellectual Property

All content available through the Service, including but not limited to original drama series, videos, images, text, graphics, logos, and software, is the property of KumaStories Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and view the content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our express written permission.

5. Copyright Infringement (DMCA Policy)

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify our Copyright Agent as set forth in the Digital Millennium Copyright Act of 1998 (DMCA). For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
  2. Identification of the copyrighted work that you claim has been infringed;
  3. Identification of the material that is claimed to be infringing and where it is located on the Service;
  4. Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and, e-mail address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and

Disclaimer of Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. KumaStories Ltd expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: To the fullest extent permitted by applicable law, in no event shall KumaStories Ltd, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

7. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in San Francisco County, California, using the English language in accordance with the Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS").

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
